I have to say the success of United State of Pop ‘08 (Viva La Pop) has exceeded my most optimistic expectations. It just hit its 1,000,000th view on Youtube, and received enough radio play to make its way onto Billboard’s Pop 100 Airplay chart, peaking at #58, and even breaking into the Pop 100 chart! Not bad, considering a total sales of $0.00, and all the marketing muscle of a guy with a website. Thank you all for your support, your comments, and for spreading the word. There are many exciting developments afoot, so stay tuned!

    Don’t get me wrong, I love mashups and I think it’s great that one of your works got into the charts, but I thought that they were illegal. How did one of them get into the top 100 of anything?

    Did you get permission from the artists in the mashup to distribute the song? Or is my knowledge of the laws totally wrong (most likely).

    Either way, great to hear of your success!

    Mashups are NOT illegal. They are an amazing Art Form that is becoming more and more popular. Earworm has been played on radio stations all over the world. Since he is not selling his mashups and since radio stations already pay for the license to play all music it is COMPLETELY legitimate. He is the future of music. You will see many more recording artists releasing mashups in the future.

    While they are technically illegal, unless one of the artists has an issue with a mashup, it will probably get freely distributed. Earworm has said that he will take down mashups that artists have problems with. However, some artists have stated that they like his mashups of their songs.

    what happens when your mashup gets into the top 25 billboard of the year, and has to end up in the next mashup, etc etc etc… that’s going to get pretty messy….

    AC1983FAN: This is what I mean. If the “mashup artist” hasn’t actively approached the artists involved in his mashups, then I can’t see how they are legal. It doesn’t matter if he is charging or giving them away for free. The music being used in the mashups are not his to use in the first place.

    If the original artists have no problem with a mashup artist using their IP, then sure, the mashup would be considered legal. However, I seriously doubt that all the mashups that DJ-Earworm or other mashup artists have created were all given the go-ahead by “all” the artists involved.

    Do get me wrong here, I love DJ-Earworm’s work and download each and ever one of his mashups. My question was how are these illegal mashups getting on the air without repercussions.

    @ Dave: He obviously didn’t get permission from all these artists. However, most record labels don’t complain about mashups except when they are whole albums I.E. American Edit, because it is basically free publicity. and anyway, the United State of Pop is made out of mostly freely available acapellas and instrumentals, i.e. they already want their work remixed/mashup. Although, I am surprised that the Beatles haven’t asked that the mashups containing their works be taken down…
